2/01.12.2025 Heard learned counsel appearing on behalf of Petitioners and
learned counsel appearing on behalf of the State.
2. The petitioners are apprehending their arrest in connection with Pakur(M) P.S. Case No. 145 of 2025, registered under sections 126(2), 127(2), 115(2), 118(1), 117(2), 109, 76, 303(2), 61(1), 352, 351(2) read with section 3 (5) of BNS, pending in the Court of learned S.D.J.M, Pakur.
3. Learned counsel for the petitioners submits that there is case and counter case between the parties. She further submits that false allegation of molestation is made in the F.I.R. She also submits that petitioners have got no criminal antecedent which is disclosed in para 9 of the petition. She next submits that the other co-accused persons have been granted anticipatory bail in ABA No.6509 of 2025. On these grounds, she submits that the petitioners may kindly be

provided privilege of anticipatory bail.

Learned counsel for the State opposes the prayer and submits that allegations of assault are there.
5. On query made by the Court with regard to statement of molestation in the case diary, learned counsel for the State submits that nothing has come in the case diary with regard to molestation.

Considering that alleged date of occurrence is 12.06.2025 and F.I.R has been lodged on 14.06.2025, there is case and counter case between the parties and the petitioners have got no criminal antecedent which is disclosed in para 9 of the petition and allegation of molestation is silent in the case diary and the other co-accused persons have been granted anticipatory bail in ABA No.6509 of
2025. In the attending facts and circumstances of the case, I am inclined to grant anticipatory bail to the petitioners.

Accordingly, the above named, petitioners are directed to surrender before the learned court within three weeks from today and in the event of their surrender / arrest, the petitioners shall be released on bail, on furnishing bail bonds of Rs. 25,000/- (twenty- five thousand) each with two sureties of the like amount each, to the satisfaction of learned S.D.J.M, Pakur, in connection with Pakur(M) P.S. Case No. 145 of 2025, subject to conditions as laid down under Section 482 (2) of B.N.S.S, 2023.
