District and Sessions - 3 - HC-KAR NC: 2025:KHC:24483 CRL.P No. 134 of 2025 Judge, Mangalore for the alleged offences punishable under Section 353, 307, 379, 279 r/w 149 IPC and u/s 8, 9 of Karnataka Prohibition of Cow Slaughter Act and u/s 11(a)(d) of Prevention of Cruelty to Animals Act and Section 4, 20, 25(B), (b) of the Arms Act. (b) Quash the entire criminal proceedings against the petitioner is concerned which is pending before the Hon'ble II Addl. District and Session Judge in S.C.No.74/2024 for the alleged offences punishable under Section 353, 307,379, 279 r/w 149 IPC and u/s 8, 9 of Karnataka Prohibition of Cow Slaughter Act and u/s 11(a)(d) of Prevention of Cruelty to Animals Act and Section 4, 20, 25(B)(b) of the Arms Act based on the chargesheet submitted by respondent No.1/Moodabidri PS. A perusal of the material on record would indicate that in the first instance, the respondent No.2 - defacto complainant the impugned complaint registered as an FIR in Crime No.213/2020 dated 11.10.2020 against Daddu Razzaq, Gantalkatte Safwan and Jabbeer that accused Nos.1 to 3 for the offences punishable under Sections 353, 307, 279, 379 r/w 34 of IPC, Sections 4, 8, 9 and 11 of Prevention of Cow Slaughter & Cattle Prevention Act, 1964 and Section 11(1)(D) of Prevention of Cruelty to Animals Act, 1960. 5. 5. In pursuance of the same, the respondent No.1 - police authorities conducted investigation and filed the impugned charge sheet, which is currently pending before the trial court in S.C.No.74/2024 against all accused persons including the petitioner who was arraigned as accused No.6 only on the ground that after the incident had occurred, he had come to the spot along with accused Nos.5 and 7. As can be seen from the charge sheet summary and the statement of witnesses and other documents produced along with the charge sheet, except stating that after the incident had happened, the accused No.4 came to the spot along with the petitioner - accused No.6 as well as accused Nos.5 and 7 and was instrumental in taking away accused Nos.1 to 3, there are no other allegations made against the petitioner - accused No.6 nor is there any material to establish the involvement of the petitioner in the - 6 - HC-KAR NC: 2025:KHC:24483 CRL.P No. 134 of 2025 alleged offences. Under these circumstances, I am of the considered opinion that continuation of the impugned proceedings qua the petitioner would amount to abuse of process of law warranting interference in the present petition. 7. In the result, I pass the following: ORDER (i) Petition is hereby allowed. (ii) The proceedings in S.C.No.74/2024 registered by the 1st respondent – Police, pending on the file of Hon'ble II Additional District and Session Judge, Mangalore for the offences punishable under Sections 353, 307, 279, 379 r/w 34 of IPC, Sections 4, 8, 9 and 11 of Prevention of Cow Slaughter & Cattle Prevention Act, 1964 and Section 11(1)(D) of Prevention of Cruelty to Animals Act, 1960 insofar as the petitioners-accused Nos.2 to 4 are concerned, are hereby quashed.
