[2025:RJ-JP:10746] HIGH COURT OF JUDICATURE FOR RAJASTHAN BENCH AT JAIPUR S.B. Civil Writ Petition No. 1224/2025 Vasudev Sharma S/o Sh. Ganpat Lal Sharma, Aged About 21 Years, R/o Bagdo Ka Bass, Vpo Titariya, Tehsil Chaksu, Dist. Jaipur. ----Petitioner Versus 1. State Of Rajasthan, Through Secretary, Department Of Sanskrit Education, Rajasthan. 2. Director Academic, Central Sanskrit University, 56-57, Institutional Area, Janakpuri, New Delhi. 3. Director, Central Sanskrit University, Jaipur Campus, Triveni Nagar, Gopalpura Bypass, Jaipur. ----Respondents For Petitioner(s) : Ms. Shikha Parnami For Respondent(s) : HON'BLE MR. JUSTICE MAHENDAR KUMAR GOYAL Judgment / Order 10/03/2025 This writ petition is filed seeking a direction to the respondents to conduct the classes of third and fourth semester of Shiksha Shastri (B.Ed.) simultaneously and to grant him a degree of Shiksha Shastri for the sessions 2023-24. The relevant facts in brief are that the petitioner was given admission in the year 2022 in Shiksha Shastri (B.Ed.) in Central Sanskrit University, Jaipur Campus where, he successfully completed both the semesters of the first year. On a complaint that the petitioner picked up a quarrel with another student at Varanasi in a national competition, before a disciplinary committee constituted to resolve the issue, the petitioner prayed for his [2025:RJ-JP:10746] (2 of 4) [CW-1224/2025] transfer to Rajiv Gandhi Campus Shringri, Karnataka but, he was offered either Ranbeer Campus at Jammu or, K.G. Saumiya Premises, Mumbai whereupon, he opted on 28.08.2023 for Shri Ranbeer Campus, Jammu. Thereafter, he requested for his transfer back to the Central Sanskrit University, Jaipur Campus which was accepted by the respondents vide letter dated 29.11.2023. Thereafter, in December 2023, the petitioner prayed that classes of his third and fourth semesters be directed to run concurrently whereupon, the Central Sanskrit University, Jaipur, vide its letter dated 20.12.2023, conveyed that he is given admission in fourth semester of the course for the sessions 2023- 2024 and for third semester, he could complete the course in the sessions 2024-2025. Thereafter, the petitioner again raised grievance vide e-mail dated 22.12.2023 but, received no response. It is averred in the memo of the writ petition that being constrained, he took admission in the fourth semester as offered but, did not appear in fourth semester examination despite completion of course of study with 62% attendance. On his request to redress his grievance, the respondent-University constituted a committee vide letter dated 03.07.2024 and the petitioner was required to attend its meeting at 11:00 am on 09.07.2024. However, as is revealed from his e-mail dated 08.07.2024, he refused to attend the meeting scheduled on 09.07.2024 pleading paucity of time. Thereafter, vide letter dated 14.10.2024, he was permitted to take admission in the third semester of the course for the sessions 2024-25 and vide letter dated 15.10.2024, he was communicated that vide letter dated [2025:RJ-JP:10746] (3 of 4) [CW-1224/2025] 14.10.2024, he has been permitted to re-register for third semester. Vide letter dated 01.01.2025, the petitioner was directed to join the third semester for the sessions 2024-25 pursuant whereupon, he has joined the third semester. In the aforesaid factual backdrop, the petitioner has made the prayer as stated hereinabove. Learned counsel for the petitioner submits that since, precious time of the petitioner was wasted in his transfer to Jammu Campus in August, 2023 and back to Jaipur Campus in November, 2023, the writ petition deserves to be allowed. She, however, despite request of the Court, could not satisfy it as to his right to get direction to the respondent-University to run classes of third and fourth semesters of the Shiksha Shastri Course simultaneously and to grant him degree in the sessions 2023-24 when, indisputably, he has not passed the second year course in that sessions or, for that matter, till date. In the meeting convened to resolve the issue with regard to petitioner’s quarrel with another student, the petitioner prayed for his transfer to Rajiv Gandhi Campus Shringri, Karnataka; but, he was offered either Ranbeer Campus at Jammu or, K.G. Saumiya Campus, Mumbai and he opted for Ranbeer Campus, Jammu. However, acceding to his further request, he was transferred back to the Jaipur Campus. Without referring to any Rule or provision permitting concurrent running of the classes of third and fourth semesters, he prayed for it which was denied by the respondent-University vide letter dated 20.12.2023 conveying that he has been given admission in fourth semester for the course for the sessions 2023-24 and the third [2025:RJ-JP:10746] (4 of 4) [CW-1224/2025] semester, he could complete in the sessions 2024-25. Thereafter, despite taking admission in the fourth semester and completing the same, he did not appear on his own in the fourth semester examination. On his further grievance, a committee was constituted by the respondent-University vide letter dated 03.07.2024 and the petitioner was required to attend its meeting on 09.07.2024; but, he refused to do so. Yet again, taking a liberal view, the respondent-University permitted him to take admission in the third semester of the course for the sessions 2024-25 which he has already joined. In view of the aforesaid discussion, this Court finds no reason to grant the relief prayed for. Even otherwise, learned counsel for the petitioner has miserably failed to satisfy this Court that as to how the scheme/curriculum of the course entitles the petitioner to undergo the third and fourth semester course concurrently and to get the degree for the sessions 2023-24 when, indisputably, out of two years course, till date, he has completed only one year of the course. Resultantly, this writ petition is dismissed being devoid of merit. Pending application(s), if any, also stands disposed of accordingly. (MAHENDAR KUMAR GOYAL),J DIKSHA /52
