1. The petitioners have prayed for a writ of mandamus directing the respondents to pay sale consideration/compensation to the petitioners in respect of their land bearing Gata nos.107 and 109 situated at Village- Pachfediya, Patti Chaubisha, Pargana- Kramangraur, Tehsil- Chakiya, District- Chandauli and to take decision on the reply dated 19.02.2025 submitted by them in response to a notice dated 14.02.2025.
2. The case of the petitioners is that they have executed different sale deeds all dated 22.06.2024 in favour of respondent no.4. However, the sale consideration/compensation amount thereunder has not been paid to the petitioners so far, rather they have been issued a notice dated 14.02.2025 by respondent no.3 stating that some part of the land is government land and their explanation has been sought as to why compensation in respect of the area belonging to the government be not set-off against the
consideration amount to be paid to them under the sale deeds. The petitioners have filed reply on 19.02.2025 and since then, the matter has remained pending and sale consideration/compensation amount is not being paid to the petitioners.
3. Learned counsel for the petitioners submits that respondent no.3 be directed to take decision in the matter expeditiously so that the compensation amount for the land transferred by the petitioners in favour of respondent no.4 is paid to them without any further delay.
4. Learned Standing Counsel does not oppose the prayer.
5. According, respondent no.3 is directed to take decision having regard to the reply dated 19.02.2025 within six weeks from the date of communication of the instant order alongwith photocopy of
the reply dated 19.02.2025.
6. The petition stands disposed of. (Anish Kumar Gupta, J.) (Manoj Kumar Gupta, J.)
