The applicant has preferred this application under Section 482 of Bhartiya Nagarik Suraksha Sanhita, 2023, for grant of Anticipatory Bail, apprehending his arrest in connection with Crime No. 62/2025, registered at Police Station – Bamhanideeh, District – Janjgir-Champa (C.G.) for the alleged commission of VAISHALI LUCKY NAGARIA Digitally signed by VAISHALI LUCKY NAGARIA Date: 2025.07.31 10:56:56 +0530 2 offence punishable under Sections 115(2), 118(1), 296, 331(5) and 351(3) of BNS. 2. As per the prosecution story, the present applicant has abuses the filthy languages to the complainant Jal Bai Chandra and also entered the house of complainant and assaulted the complainant and her husband from the belt. Therefore, crime has been registered against the present applicant. 3. Learned counsel for the applicant submits that the applicant has been falsely implicated in this case. He further submits that the applicant has neither committed nor participated in any such act, due to some old dispute, the complainant has made false complaint against the applicant. Therefore, he prays for grant of anticipatory bail to the present applicant. 4. On the other hand, learned State counsel opposes the submission made by the learned counsel for the applicant. She further submits that applicant entered the house of the complainant and assaulted the complainant namely Jal Bai Chandra and her husband from the belt, as a result of which they received injuries and the applicant has some criminal antecedent in connection with crime No.07/2024 for the offence under Sections 294, 506, 323, 34 of IPC registered at Police Station – Bamanideeh, in Istagasa No. 37/2024 for the offence under Sections 107 and 116(3) of Cr.P.C at Police Station Bamanideeh, in crime No.24/2025 for the offence under Sections 126 and 135(3) of BNS at Police Station Bamhanideeh and in Crime No.449/2024 for the offence under Section 498(A) 3 and 34 of IPC at Police Station Chowki Naila, District- Janjgir- Champa (C.G.) and all these cases are pending before its conclusion Therefore, he is not entitled for grant of anticipatory bail. 5. I have heard learned counsel for the parties and perused the case diary. 6. Considering the nature and gravity of the offence and material available on record in the case diary and also considering the fact that that applicant entered the house of the complainant and assaulted the complainant namely Jal Bai Chandra and her husband from the belt, as a result of which they received injuries, applicant has some criminal antecedent in connection with crime No.07/2024 for the offence under Sections 294, 506, 323, 34 of IPC registered at Police Station – Bamanideeh, in Istagasa No. 37/2024 for the offence under Sections 107 and 116(3) of Cr.P.C at Police Station Bamanideeh, in crime No.24/2025 for the offence under Sections 126 and 135(3) of BNS at Police Station Bamhanideeh and in Crime No.449/2024 for the offence under Section 498(A) and 34 of IPC at Police Station Chowki Naila, District- Janjgir-Champa (C.G.) and all these cases are pending before its conclusion. Applicant is habitual offender and looking to the conduct of the applicant, as such, I am not inclined to grant anticipatory bail to the applicant. 7. Accordingly, the anticipatory bail application of the applicant– Thakur Chandrabhash @ Thakur Singh, filed under Section 4 482 of Bhartiya Nagarik Suraksha Sanhita, 2023 involved in Crime No. 62/2025, registered at Police Station – Bamhanideeh, District – Janjgir-Champa (C.G.) for the alleged commission of offence punishable under Sections 115(2), 118(1), 296, 331(5) and 351(3) of BNS is rejected. 8. Needless to say that the trial Court concerned is at liberty to proceed and conclude the trial expeditiously. 9.
