ORDER:
The present Writ Petition is filed under Article 226 of the Constitution of India for the following relief:
"…..to issue an appropriate writ, order or direction, more particularly one in the nature of Writ of Mandamus declaring the action of the respondent authorities in not releasing the amount of Rs.8,50,710/- (Eight Lakh Fifty Thousand Seven Hundred and Ten Only) for the work executed by the petitioner under Work despite issuing Fund Transfer Orders under F.T.R. Nos.9092019100005, 9092019100076, 9092020000469, 9092019100004, 90920210000282, as arbitrary, illegal, contrary to Law and against the Principles of Natural Justice and to issue a consequential direction directing the respondent authorities to release the amounts payable to the petitioner with an interest at the rate of 24% per annum and pass such other order or orders….."
2. The work of “Development of Housing Colony under the scheme of The Mahatma Gandhi national Rural Employment Guarantee Scheme, A.P.” was allotted to the petitioner on nomination of basis. After completion of the work, the petitioner was paid 75% of the bill amount and the remaining 25% of the bill amount is not paid to the petitioner even after three years. The petitioner has approached the authorities on several occasions with a request to release the amount. But however, the respondents made a deaf ear. Hence, the Writ

Petition is filed for release of the remaining 25% of the bill amount due to the petitioner. 3.
The 6th respondent-Madapalli Gram Panchayat filed counter and admitted that the petitioner has executed the work in Madapalli Gram Panchayat under Mahatma Gandhi National Rural Employment Guarantee Scheme (MGNREGS) with work ID Nos.091282005003170714, 091282005003170715 and 091282005003170765 for leveling and development of Housing Colony and this Gram Panchayat paid Rs.9,48,711/- through FTO No.9092020001410, FTO No.9092019100004, FTO No.9092019100005, FTO No.9092019100076, FTO No.9092020000469, FTO No.9092020000524, FTO No.9092019100013 and FTO No.9092020001409 to the petitioner and it is stated that an amount of Rs.8,16,345/- was due to the petitioner herein and the same will be paid to the petitioner after receiving the amount from the State Government. 4. As per the aforesaid counter, the respondents have admitted the work executed by the petitioner and the amount due to the petitioner for the execution of work. 5. In view of the aforesaid admission made by the respondents, the Writ Petition is disposed of, directing the respondents to pay the admitted amount due to the petitioner within a period of eight (8) weeks from the date of receipt of a copy of this order, failing which, the petitioner is entitled to interest @ 6% per annum from the date of Writ Petition till the date of realization. There shall be no order as to costs. 4
