Neutral Citation No. - 2025:AHC:51565-DB Court No. - 39 Case :- WRIT - C No. - 10485 of 2025 Petitioner :- Sabir Hussain Respondent :- State Of U.P. And 8 Others Counsel for Petitioner :- Sandeep Kumar Counsel for Respondent :- Anil Kumar Tiwari,C.S.C. Hon'ble Arindam Sinha,J. Hon'ble Syed Qamar Hasan Rizvi,J. Mr. Sandeep Kumar, learned advocate appears on behalf of petitioner and submits, respondent nos.4 and 5 are seeking to interfere with his client's possession of his property. This is at instance of private respondent nos.6 to 9. He seeks interference. Mr. Ambrish Shukla, learned advocate, Additional Chief Standing Counsel appears on behalf of State and draws attention to paragraph 8 to submit, there is existing civil dispute. Mr. P.K. Mishra, learned advocate appears on behalf of respondent nos.7 to 9. He submits, respondent no.6 has died. Petitioner's cause to sue respondent no.6 survives against respondent nos.7 to 9. As such, at this stage there is no necessity for substitution. Considering there has been reliance on Civil Court order obtained by petitioner, it is expected that the police (respondent nos.4 and 5 herein) will assist the person who has the order and not otherwise. The least they can do is remain neutral unless specifically called upon by written complaint, to interfere. With above observations, the writ petition is disposed of.
