Petition under Article 226 of the Constitution of India praying that in the circumstances stated in the affidavit filed therewith, the High Court may be pleased to issue a writ, order, or direction, particularly one in the nature of a writ of Mandamus or any other appropriate writ, declaring the action of Respondents 2 and 5 in not following the directions of the Central Government and in carrying out allied activities of converting raw cotton and selling it through e-auction in different categories not mentioned in the objectives of the Memorandum of Association (MCA) of Respondent No. 2, as illegal, arbitrary, ultra vires andvoid as per the Companies Act 2013 and also violates the clause III (A)(5) of the MCA and also article no 19(1)(g), 21 of the Constitution of India, thereby adversely affecting the livelihood of the Petitioner /Traders and thereby direct the Respondent No.2 to implement the Governments decision only to procure cotton and sell the same as mentioned in the MCA without any ultra vires activities and pass IA NO: 1 OF 2024 Petition under Section 151 CPC praying that in the circumstances stated in the affidavit filed in support of the petition, the High Court may be pleased it is humbly prayed that since there is no permission of the Central Government to do any of the allied activities and if the Respondent No.2 continues to do the ultravires activities then the petitioner/traders will lose the source of livelihood which is guaranteed under article 21, 19 (1)(g) of The Constitution of India, hence to direct the Respondent No.2 to follow The Companies Act 2013 strictly In toto and thereby to restrain and not to carry out any activities ultravires the Memorandum of Association (MCA) of the company then only the petitioner/traders will be able to survive in the present day competitive market/world and pass Counsel for the Petitioner:
