RAGHUNANDAN RAO DATE : 23rd January 2025 PC : The limited controversy in the present petition is that S.A.No.121 of 2022 filed by the petitioners before the Debts Recovery Tribunal, Visakhapatnam as early as in March, 2022 still remains to be decided along with l.A.No.2771 of 2023 filed by the petitioners seeking release of the property which was the secured asset with the respondent bank. It is stated that an amount of Rs.3,86,00,000/- was paid to the extent the applicants’ predecessor stood as guarantor to the principal borrower and having received the entire amount, there was no justification for the bank to not return the papers and release the said property. 2. 2 3. Considering the innocuous prayer made, we dispose of this petition with a direction to the Debts Recovery Tribunal, Visakhapatnam to dispose of I.A.No.2771 of 2023 in S.A.No.121 of 2022 within a period of six (6) weeks positively.
