ORDER: This Criminal Petition under Section 480 and 483 of the Bharatiya Nagarik Suraksha Sanhita (BNSS), is filed seeking tO enlarge the petitioners herein on bail in Crime No.341 of 2024 of Pendurthy Police Station, Visakhapatnam District registered for the offences punishable under Sections 20(b)(ii)(C) r/w 8(c) and 25 of NDPS Act,1985. 2. Heard learned counsel for the petitioners and learned Assistant Public Prosecutor for the Respondent-State. 3. Learned Assistant Public Prosecutor submitted that there are no previous antecedents against the petitioners. 4. Perused the record. 5. On hearing learned counsel for both sides and On Perusal Of the record, it is seen that the present Crime was registered on 15.07.2024 and 284.78 Kgs of Ganja was recovered from the possession of the petitioners herein. The petitioners have been in judicial custody since 15.07.2024 and major part of the investigation was completed. =) I £

6. A perusal of the material on record shows that the petI'tI®OnerS were arrested on 15.07,2024 and sl'nce then they have been languI'ShI'ng in jail. The statutory period of 180 days js completed.
But, the poll'ce neither filed any charge sheet within the stipulated tI'me nor any appII'CatI'On for extension of time for investjgatjon. since the petI'tjOnerS herel®n are [angujshjng in jail for the past more than 180 days and so far no charge sheet has been filed by the poII'Ce, in such cI-rCumStanCeS, I-rreSPeCtiVe Of merits of the matter by default petitl'oners are entitled for bail. 7. In the result, the crjmI-hal Petition Its a"owed, on the fo"owing condjtjons. (i) The petitI'OnerS hereI-n Shall be released on bail on their executI'ng a personal bond for Rs.10,000/- (Rupees ten thousand only) each wI-th two Sureties for a like sum each to the satisfaction of the learned v" Additional Metropolitan Magistrate court, Visakhapatnam. (ill) On such release, the petI-tiOnerS Shall appear before the station House offl'cer concerned once in a week i.e., on every sunday between 10.00 a.m. and o5.00 p.m., for a pert-Od Of three months or till filing of the charge sheet, whI'CheVer iS earlier.
