PUBLIC PROSECUTOR The Court made the following: ORDER: This Criminal Petition under Section 482 of Bharatiya Nagarik Suraksha Sanhita, 2023 is filed on behalf of the petitioner/accused No.87, seeking anticipatory bail in connection with Crime No.137 of 2023 of Gannavaram Police Station, Krishna District, registered for the 2 offences punishable Section under Sections 143, 147, 148, 435, 506 r/w 149 of IPC and Section 3(1)(r)(s) of the Scheduled Castes And Scheduled Tribes (Prevention off Atrocities) Act, 1989. 2. Heard Sri G.Sambasiva Rao, learned counsel for petitioner/accused No.87, and Sri K.Sandeep, learned Assistant Public Prosecutor for respondent/State. 3. Perused the record. 4. Having heard the learned counsel on both sides and perused the record, it is seen that this is a pre-arrest bail petition filed by the petitioner/A87. A perusal of the record shows that the offences registered in the FIR are under IPC as well as the Scheduled Castes And Scheduled Tribes (Prevention off Atrocities) Act, 1989. In such circumstances, with respect to the other accused in the same crime, this Court dismissed the petitions, observing that there is a Jurisdictional bar for this Court under Section 14(A)(2) of the Scheduled Castes And Scheduled Tribes (Prevention off Atrocities) Act, 1989 to exercise original Concurrent Jurisdiction. 5. In these circumstances, this petition is dismissed, with liberty to the petitioner/A87 to file an appropriate application before the appropriate Court seeking appropriate relief. Upon presentation of such petition, the learned Special Judge shall hear the matter on the judicial side and dispose of it in accordance with the law. 3 6. In the result, the criminal petition is dismissed.
