Neutral Citation No. - 2025:AHC:52394 Court No. - 4 Case :- WRIT - A No. - 4474 of 2025 Petitioner :- Sunil Kumar Tripathi Respondent :- State Of U.P. And 3 Others Counsel for Petitioner :- Ankit Kumar Mishra,Avneesh Mishra,Vikrant Pratap Singh Counsel for Respondent :- C.S.C. Hon'ble Ajit Kumar,J. 1. Heard Sri Vikrant Pratap Singh, learned counsel for the petitioner and learned Standing Counsel for the State. 2. By means of this petition filed under Article 226 of Constitution of India, the petitioner has questioned the chargesheet dated 23.01.2025 served upon him in instituting disciplinary proceedings raising the plea of malafides. 3. It is next submitted that previously the petitioner had challenged the order of suspension which had been stayed vide order dated 23.09.2024 passed in Writ A No.13992 of 2024. 4. From the perusal of the order of stay, it clearly transpires that the Court had let it open for the respondents to proceed with enquiry which would be brought to its logical end in accordance with law. Petitioner was also directed to cooperate in the enquiry. 5. In such above view of the matter, once a coordinate Bench of this Court had already directed disciplinary authority to proceed with the enquiry, this Court cannot sit in appeal over and above the order of stay dated 23.09.2024 and the directions issued therein. 6. Hence I decline to grant indulgence in the matter. Petition fails and is accordingly, dismissed.
