The petitioner has been made accused in connection with Ramgarh (Mahila) P.S. Case No. 01 of 2024 corresponding to POCSO Case No. 02/2024, for the offences registered under Sections 323, 376/34 of the Indian Penal Code and Section 4 & 8 of the POCSO Act, pending in the court of learned Sessions Judge, Ramgarh. 3. On 07.01.2024 at about 5:00 P.M., the petitioner is alleged to have raped the victim at a place behind Chittarpur Block. 4. It was submitted that there is two days’ delay in lodging of F.I.R. It was further submitted that co-accused Arun Kumar Mahto has been granted bail by this Court earlier. It was also submitted that victim has not been medically examined. It was also submitted that mobile phone of the victim was not recovered and the police has not obtained location of mobile phone of the victim. It was finally submitted that the petitioner is in custody since 11.01.2024. 5. Considering the nature of allegation, I am not inclined to release the petitioner, on bail.
