Rajasthan High Court, Through Its Registrar General New High Court Building, Jhalamand, Jodhpur. ----Respondents For Petitioner(s) : Mr. Falgun Buch For Respondent(s) : Mr. Mahaveer Bishnoi, AAG Mr. S.P. Sharma HON'BLE DR. JUSTICE PUSHPENDRA SINGH BHATI HON'BLE MR. JUSTICE YOGENDRA KUMAR PUROHIT Order 09/01/2025 1. Learned counsel for the petitioner makes a limited submission that though RGHS rates of the treatment have been paid but the hospital has charged beyond the RGHS rates and since the hospital is empanelled with the State Government, they were required to adhere to the rates of RGHS. 2. On such submission, it is clear that RGHS rates have already been paid by the respondent, though there is a difference in [2025:RJ-JD:1357-DB] (2 of 2) [CW-15742/2023] payment received as the emergency treatment called for was costlier than the RGHS reimbursement rates. 3. Since, admittedly the State has refunded the RGHS authorised amount, therefore, no cause of interference is called for in the present writ petition. Accordingly, the writ petition is disposed of. 4. However, the petitioner shall be at liberty to seek refund of the excess payment from the hospital concerned, if the hospital was having the RGHS Scheme prevailing, strictly in accordance with law.
