GP FOR MINES AND GEOLOGY The Court made the following order: Challenging the action of the respondents in not granting dispatch permits for transportation of building stone and gravel over an extent of 2.986 Hectors in Sy.No.11 of Parvada Village and Mandal, Anakapalli District, the present writ petition is filed. 2. It is contended that the writ petition is filed challenging the action of the respondents in not issuing dispatch permits; on the pretext that a demand notice was pending in the case of the petitioner. 3. Today when the matter is taken up for hearing, learned counsel for the petitioner has brought to the notice of this Court that the petitioner has filed a Writ Petition vide W.P.No.22382 of 2024, challenging the proceedings of the respondents in raising demand notice against the writ petitioner, the same was disposed of on 20.01.2025. 4. A perusal of the said order, would reflect that the demand notice dated 06.09.2024 issued by the 3rd respondent was set aside and the matter was remanded back to the 3rd respondent with a direction to conduct fresh enquiry and pass appropriate reasoned orders. 5. Having regard to the submissions, this Court is of the considered view that as there is no demand notice pending as of date against the petitioner, the respondents are directed to issue dispatch permits, on payment of required charges, to the petitioner. 6. With the above direction, the Writ Petition is disposed of. No costs.
