1. Learned Counsel for the Petitioner submits that the Petitioner is working as a daily wager employee on the post of Assistant-cum-Data Entry Operator since 2011 and he has filed a copy of the order dated 25.6.2011 which goes to show that since 2011 the Petitioner is working as Computer Operator on daily wage. It has been submitted by Learned Counsel for the Petitioner that the Petitioner is still working as a daily wager employee, however, an advertisement dated 27.11.2024 has been issued for appointment of Computer Operator on contract basis, as such he is apprehending that he will be removed whereas he is working since last more than 13 years as such he is praying that according to the judgment of the Hon’ble Supreme Court in the case of Secretary, State of Karnataka v. Umadevi, (2006) 4 SCC 1 and Narendra Kumar Tiwari v. State of Jharkhand, (2018) 8 SCC 238, the authorities may be directed to consider his case for regularisation and for that he will file an application. He is praying that the authorities may be directed to consider the case of the Petitioner in a pragmatic manner in order to consider his case for regularisation according to Umadevi case (supra).
He also submits that the State Government has also issued a circular dated 5.3.2008 according to which regularisation can be done if the employee is in continuous work for about 10 years. 3

Considering the aforesaid aspect of the matter, this writ petition is disposed of with a direction that in case an application/representation before the concerned authority is filed by the petitioner, the concerned authority shall decide the same in accordance with law.
