It is noticed that the Assistant Commissioner has dismissed the appeal only because a suit was pending in the Civil Court for partition. 2. The Assistant Commissioner has not even stated as to in what manner the said suit is connected with the appeal. 3. However, it is also noticed that, as against the order of the Assistant Commissioner, the petitioner has the remedy of filing a revision before the Deputy Commissioner under Section 136(3) of the Karnataka Land Revenue Act. 4. I am therefore of the view that, it would be appropriate to relegate the petitioner to file a revision petition before the Deputy Commissioner challenging the order of the Assistant Commissioner. - 4 - NC: 2025:KHC:10580 WP No. 36533 of 2024 5. It is needless to state that the Deputy Commissioner shall decide the revision petition expeditiously, if it is filed within a period of two weeks from today. 6. The Deputy Commissioner shall also ensure that notices of revision are served on the respondents through their counsel, who represents them in O.S.No.1387/2005. 7. This writ petition is accordingly disposed of. 8. In view of the disposal of the petition, all pending interlocutory applications, if any, stand disposed of.
