PUBLIC PROSECUTOR The Court made the following ORDER: This Criminal Petition, under Sections 480 and 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023, has been filed by the petitioners/A3 and A4, seeking regular bail, in Crime No.70 of 2024 of Chintoor Police Station, Alluri Sitharama Raju district. 2. A case has been registered against the petitioners herein and others for the offences punishable under Section 111(2)(b) 2 of the Bharatiya Nyaya Sanhita, 2023 and Section 8(c) read with 20(b)(ii)(C) of the Narcotic Drugs and Psychotropic Substances Act, 1985 (for short ‘the NDPS Act’). 3. Case of the prosecution, in brief, is that, on 17.09.2024, at about 07.00 PM, on credible information, the Sub-Inspector of Police, Chintoor Police Station, along with his staff and mediators, while conducting vehicle checking, found A3 and A4 in possession and illegal transportation of 100 Kgs of Ganja in Swift Dzire Car bearing registration No.MH 12 GZ 7367. On interrogation, A3 and A4 confessed that they fetched the Ganja from A2 at the instance of A1 who provided the Car to bring the Ganja. The contraband along with vehicle and other material was seized under cover of a mediators report and a case has been registered against the accused. A1 and A2 were absconding. 4. Heard. Perused the record. 5. A perusal of the material on record goes to show that 100 Kgs of ganja was seized from the possession of the accused, which is a huge commercial quantity. It is submitted by the learned Assistant Public Prosecutor that investigation is not yet completed and A1 and A2 are to be apprehended. 3 6. In view of the aforesaid facts and circumstances of the case, this Court is not inclined to grant bail to the petitioners/A3 and A4. 7.
