Heard the parties.
The petitioner has been made accused in connection with Tisri P.S. Case No. 63 of 2024, corresponding to G.R. Case No.11 of 2025, for the offences registered under Sections 103(1), 238, 3(5) of the B.N.S., 2023, thereafter cognizance has been taken under Sections 103(1), 238, 61(2), 3(5) of the B.N.S., pending in the court of Ms. Ruby, learned J. M. 1st Class, Giridih. On 15.09.2024, husband of the informant went missing. On 16.09.2024 at about 7:00 A.M. dead body of her husband was recovered from a place near Belwana Soti.
Learned counsel for the informant has vehemently opposed the prayer for bail and submitted that the mobile phone of the deceased has been recovered on the pointing out of this petitioner. It was further submitted that one witness has identified this petitioner and co-accused that they were last seen with the deceased prior to the occurrence. Report earlier called for from the learned trial court whether confessional statement of the petitioner was annexed with the case diary, has been received. Learned trial court has reported that the confessional statement of the petitioner has not been recorded. In view of the submissions made above, I am inclined to enlarge the petitioner on bail. Accordingly, the petitioner, above named, is directed to be released on bail on furnishing bail bonds of Rs. 20,000/- (Rupees twenty thousand) with two sureties of the like amount each, to the satisfaction of Ms. Ruby, learned J. M. 1st Class, Giridih or her successor, in connection with Tisri P.S. Case No. 63 of 2024, corresponding to G.R. Case No.11 of 2025.
