No. 3366/2023 on the file of pending before the VI Additional Senior Civil Judge and A.C.M.M., at Bengaluru for the offences alleged under Section 138 of Negotiable Instruments Act in the interest of justice and equity. ii) Grant such other and further reliefs based on the nature and circumstances of the above case, in the interest of justice and equity.” 2. Heard learned counsel for the petitioner and perused the material on record. 3. Though several contentions have been urged by the petitioner in support his claim, the material on record discloses that there are several contentious issues and disputed questions of fact and law that arises for consideration between the parties, which would necessarily have to be decided only after a full fledged trial, without expressing any opinion on the merits/demerits of the rival contentions, I deem it just and appropriate to dispose of this petition leaving open all contentions between the parties to be - 3 - NC: 2025:KHC:5743 CRL.P No. 14337 of 2024 urged before the Trial Court, which shall be considered in accordance with law. 4.
