The Hon'ble JUSTICE OM NARAYAN RAI Date : 17th September, 2026 Appearance: Mr. Arnab Dutt, Adv. …for the petitioner The Court:- This is an application for grant of Letters of Administration as in case of intestacy (i.e. without the Will annexed) in respect of the estate left behind by the abovenamed deceased. The deceased no. 1 was the husband of the deceased no. 2. They died issueless. The parents of the deceased no. 1 pre-deceased him. The affidavit of assets indicates that all the properties comprising the estate of the deceased devolve exclusively in accordance with the lineal succession of the deceased no. 1. The legal heirs who would have otherwise succeeded to the estate would therefore have been the heirs of the deceased no. 1. Since there are no class-I heirs of the deceased no. 1, the brothers of the deceased no. 1 are the only legal heirs. They have been described in paragraph 5 of the application.
2 The deceased had three brothers. One of them is the applicant before this Court and the other two have consented to the grant by filing affidavits of consent. Having regard to the above and since the file has been placed before this Court by the Registrar Insolvency for grant, upon complete scrutiny by the Department, therefore, considering the view of the Department, this application for grant of Letters of Administration is allowed by passing orders in terms of prayer (a) of the application subject to the petitioner furnishing a personal bond for a sum of Rs.1,80,000/- (Rupees One Lakh Eighty Thousand only) with one surety. PLA/108/2025 stands disposed of.
