Dr. Prakash Chandra Sharma, Chief Medical And Health Officer, Rajsamand. 2. Shri Mukul Sharma, Director (Non - Gazetted), Department Of Medical And Health, Swasthya Bhawan, Jaipur. 3. Shri Mahesh Sharma, Registrar, Rajasthan Nursing Council, B-19, Sardar Patel Marg, C-Scheme, Jaipur. 4. Shri Vaibhav Galriya, Secretary, Medical And Health Services, Rajasthan, Secretariat, Jaipur. 5. State Of Rajasthan, Through Its Secretary, Department Of Medical Health And Family Welfare, Secretariat, Jaipur. ----Respondents For Petitioner(s) : Mr. Yashpal Khilree For Respondent(s) : Mr. Sangram Singh Mr. N.S. Rajpurohit, AAG JUSTICE DINESH MEHTA Order 13/01/2025 1. By way of present petition, petitioner has alleged non- compliance of the order dated 04.08.2021 as the respondent – Rajasthan Nursing Council has not issued certificate or registration to her. 2. Mr. Sangram Singh, learned counsel for the respondent No.3 submitted that the order dated 04.08.2021 was only to the effect of providing provisional registration certificate and the same has (2 of 2) [WCP-788/2021] been issued to the petitioner on 28.07.2021 and she has been given an appointment on the basis of such certificate. 3. Learned counsel for the respondent council further submitted that the respondent - Rajasthan Nursing Council is continuously pursuing the Madhaya Pradesh Nursing Council to issue NOC but the same is still awaited. He argued that unless the State of Madhya Pradesh, from where the petitioner has done diploma in ANM issues NOC, the Rajasthan Nursing Council cannot issue requisite registration certificate to the petitioner. 4. Be that as it may. Considering that provisional registration certificate (order dated 28.07.2021) has been issued to the petitioner, this Court does not find any reason to proceed against the respondents. 5. Notices of contempt are hereby discharged. 6. Needless to observe that until the respondent – Rajasthan Nursing Council revokes or cancel the provisional registration certificate dated 28.07.2021, the same shall be treated valid for not only the present engagement but also for future/regular recruitment to be undertaken by the State Government. 7. It shall also be required of the respondent council to renew the same, (in case the petitioner applies) in accordance with law, for which no separate order shall be insisted upon.
