PUBLIC PROSECUTOR The Court made the following order :- A.7 in Crime No.42 of 2023 of Chinthapalli Police Station, filed the present application under Section 480 and 483 of Bharatiya Nagarik Suraksha Sanhita, 2023, seeking his release on bail. The said crime was registered for the offence under Section. 20 (b) (ii) (C), 25 read with 8(c) of the Narcotic Drugs and Psychotropic Substances Act, 1985. 2. The case of prosecution is that on 09.08.2023 at about 7.30 A.M., the Sub Inspector of police, Chinthapalli Police Station, while conducting vehicle checking near teak plantation, Sadika village, Yerrabommalu panchayat, he noticed three persons in an auto and on 2 a motor cycle and he apprehended A.1 to A.3 who were found in transporting 489.110 kgs of Ganja. On interrogation, A.1 to A.3 confessed that they purchased Ganja from A.7. The petitioner/A.7 was produced under P.T. warrant on 25.07.2024. 3. Learned counsel for the petitioner contends that no contraband was seized from the possession of petitioner and he came to be implicated in the present crime only on the confession made by the arrested accused. As such, she requests this Court to enlarge the petitioner on bail. 4. On the other hand, learned Additional Public Prosecutor submits that the contraband involved in the present crime is 489.110 kgs which is a commercial quantity. He further contends that the petitioner was involved in similar crime previously also. 5. This court perused the material on record. 6. In view of the above facts and circumstances, as the contraband involved in the present crime is 489.110 kgs which is a commercial quantity and as the petitioner was involved in similar crime previously also, this Court is not inclined to grant bail to the petitioner at this stage. 7. Accordingly, the Criminal Petition is dismissed.
