K.M.Krishna Reddy The Court made the following: 2 C.C.No.4869 of 2024 Order: This contempt case is filed under Sections 10 and 12 of Contempt of Courts Act, 1971, to punish the respondents and punish them for their wilful disobedience of order of this Court dated 11.11.2024 in W.P.No.24442 of 2025. 2. The operative part of the order dated 11.11.2024 reads as follows: “For all these reasons the inquiry held by the 4th respondent for passing the impugned order is not sustainable under law and liable to be set aside. Since due inquiry is not conducted while setting aside the impugned order, liberty is given to all authority to conduct a fresh inquiry by following due procedure of law. Accordingly, the writ petition is allowed. There shall be no order as to costs.” 3. The responded No.1 filed counter which states briefly as follows: a. Pursuant to the order of this Court, a show cause notice was issued to the petitioner by the respondent No.1 vide R.C.No.539/2024/C dated 24.12.2024 for conducting fresh enquiry. Accordingly, the petitioner attended the office of the respondent No.1 on 31.12.2024 and gave the statement. The card holders of F.P.Shop No.1256017 of kallur village and S.H.G. member of Chennakaseva Mahila Sangham, Kalluru village gave statements. The 2nd show cause notice was given by the respondent No.1 to the petitioner vide Rc.No.539/2024/C dated 10.01.2025 to appear personally and submit her explanation on 18.01.2025 regarding the allegations received against her. The 3 C.C.No.4869 of 2024 petitioner was served a show cause notice along with the following documents: 1. This office show cause notice vdie Rc.No.539/2024/C dated 24.12.2024. 2. Statement received from the previous dealer Smt.Subhashini W/o Naresh dated 31.12.2024. 3. Statement received from the S.H.G members of Chennakesava Mahila Sangham, Kalluru village dated 28.12.2024. 4. Statement received from the card holders of F.P.Shop No.1256017 of kallur village. 5. Tahsildar, Lepakshi report vide Rc.No.121/2024/C dated 19.07.2024. 6. Complaint received from Sri.Lakshmi Chennakesava Mahila Sangham, dated 15.07.2024. 7. Complaint received from the card holders of F.P.Shop No.1256017 of kallur village dated 12.07.2024. b. The petitioner submitted explanation in reply to the show cause notice. Thereafter, the respondent No.1 passed order cancelling dealership of the petitioner for F.P show No.12567017 vide RC No.539/2025/C dated 22.01.2025. Thus, the order of this Court has been duly implemented by conducting fresh enquiry by following due process of law. Therefore, it is prayed to dismiss the petition. 4. The respondent No.2 also filed counter on the same lines. 5. Heard the learned counsel for the petitioner and the learned counsel for the respondents. 4 C.C.No.4869 of 2024 6. As the order has been duly complied, the petition is closed giving liberty to the petitioner to challenge the order dated 22.01.2025 Rc.No.539/2024/C as per law before appropriate authority. There shall be no order as to costs.
