Verma For Respondent(s) : Mr. Sharwan Singh Rathore, PP HON'BLE DR. JUSTICE PUSHPENDRA SINGH BHATI Order 13/01/2025 1. The petitioners have been arrested in connection with FIR No.218/2020 of Police Station Ramsinghpur, District Sriganganagar for the offences punishable under Section 8/22 and 29 of NDPS Act. They have preferred these bail applications under Section 439 Cr.P.C. [2025:RJ-JD:1918] (2 of 2) [CRLMB-1452/2024] 2. Learned counsel for the petitioner submits that the accused were apprehended with a bag containing 2,000 tablets weighing 840 grams. He further submits that both the accused have completed their four years of custody as they are in custody since 01.10.2020. He further submits that trial is likely to take a long time, thus, the bail application of the petitioners may be granted. 3. Learned Public Prosecutor opposes the bail applications of the petitioners on the ground that commercial quantity of contraband was recovered from the possession/presence of both accused persons and looking into the heinous nature of crime, the release of the petitioners from custody is not warranted. 4. Having considered the quantum of contraband involved and the fact that both petitioners were present at the spot of recovery, this Court is not inclined to grant bail to the petitioners. However, the petitioners shall be at liberty to file fresh bail applications after completing five years in custody. This Court has also kept into consideration that no such empathetic factor has been brought to the knowledge of the Court by the counsel for the petitioner, which would entitle him to bail. 5. Consequently, the bail applications of the petitioners are dismissed. (DR.PUSHPENDRA SINGH BHATI),J 14-15-Sudheer/-
