05/ 19.12.2025 Heard learned counsel for the petitioner, who is appearing through V.C. and learned A.P.P for the State.

The petitioner is apprehending his arrest in connection with Bistupur P.S. Case No. 227 of 2024, registered for the offence under Sections 376(2)(n), 313, 498-A, 494, 504, 506 and 34 of the Indian Penal Code, pending in the court of learned Chief Judicial Magistrate, Jamshedpur.

Learned counsel appearing for the petitioner through V.C. submits that the petitioner has earlier moved before this court in A.B.A. No. 5228 of 2024, however, which has been subsequently, dismissed as withdrawn due to the fact that by that time, the notice under Section 35(3) of Bharatiya Nyaya Sanhita, 2023 was not issued to the petitioner and that statement has been made in para-14 of this petition. She next submits that now the notice has been received by the petitioner and the same has been replied and in that view of the matter the second anticipatory bail application has been filed.

Learned counsel appearing for the petitioner submits that

the wife of the petitioner has lodged an FIR against the informant and thereafter the present FIR has been lodged against the petitioner and the petitioner has been falsely implicated in this case. She further submits that even the wife of the petitioner has not been spared, however, the wife of the petitioner has already been provided the privilege of anticipatory bail in A.B.A. No. 5248 of 2024 by the co- ordinate bench of this court.

Learned A.P.P. appearing for the State has opposed the prayer and submits that the allegations are there of mischief.

Annexure-2 is the FIR, being Bistupur P.S. Case No. 222 of 2024, which has been lodged by the wife of the petitioner against the informant on 02.07.2024 and thereafter the present case has been lodged by the informant on 05.07.2024. It transpires from the records that the petitioner is the judicial officer, which prima facie suggests that the petitioner has been falsely implicated in this case.

In the attending facts and circumstances of the case, I am inclined to grant anticipatory bail to the petitioner.

Accordingly, the petitioner, named above, is directed to surrender before the learned court within four weeks from today and in the event of his surrender / arrest, the petitioner, named above, shall be released on bail, on furnishing bail bonds of Rs. 25,000/- (twenty-five thousand), with two sureties of the like amount each, to the satisfaction of learned Chief Judicial Magistrate, Jamshedpur, in connection with Bistupur P.S. Case No. 227 of 2024, subject to conditions as laid down under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023.
