GOLLAPALLI MAHESWARA RAO COUNSEL FOR THE RESPONDENT : PUBLIC PROSECUTOR THE COURT MADE THE FOLLOWING ORDER THE HONOURABLE SRI JUSTICE K SREENIVASA REDDY CRIMINAL PETITION ORDER: NO. 9606 OF 2024 This Crim|lnal Petition, under Sections 480 and 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023, has been filed by the petitioners/Al and A2, seeking regular bail, in Crime No.172/2024 of Devarapalli Police Station, Anakapalli district. 2. A case has been registered against the Petitioners herein and others for the offences punishable under Sections 20(b)(ii)(C), 25 read with 8(c) of the Narcotic Drugs and Psychotropic Substances Act, 1985 (for short lthe NDPS Act'). 3. Case of the prosecution in brief iS that On 19.09.2024, at about o5.30 PM, the Sub-Inspector Of Police, Devarapalli Police Station, along with his staff and mediators, while conducting vehicle checking at srirampuram Junction of Devarapalli MandaI, found Al to A3 in possession and illegal transportation of 64 Kgs of Ganja in a Maruthi suzuki white colour car bearing registration No.AP 23 AA 4156. The contraband along with vehicle and other material was seized under cover of a mediators report and a case has been registered against the accused. 4. Heard. Perused the record, c'3SSSfifir- 5. A perusal of the material on record goes to show that the contraband allegedly seized from the possession of the accused is 64 Kgs of Ganja. The petitioners/Al and A2 were arrested on 19.09.2024 and since then they are languishing in jail. Learned Assistant Public Prosecutor submits that major portion of the investl'gation l's completed and charge sheet is not yet filed for want of arrest of remaining accused. 6. In view of the aforesaid facts and circumstances of the case, this Court I-s inclined to grant bal-I to the petitioners/Al and A2 on the following conditions. i) The petitioners/Al and A2 shall be released on bail on their executing personal bond for Rs.10,000/-(Rupees Ten Thousand only) each with two sureties of the like sum each to the satisfaction of the learned I Additional District & SessI'OnS Judge-Gum-special Judge for Trial of Offences under the NDPS Act, Visakhapatnam,I ii) On release, the petitioners shall appear before the station House Officer concerned, once ill a Week i.e. on every Saturday between 10.00 am and 01.00 pm, till filing of the charge sheet. 7.
