This civil miscellaneous petition has been filed at the instance of the petitioner for restoration of M.A. No. 220 of 2019 to its original file. Learned counsel for the petitioner submits that M.A. No. 220 of 2019 was dismissed for non-compliance of peremptory order. It is next submitted that the counsel for the petitioner could not attend the Court when the case was called out as the counsel were directed to not attend the Court from Bar Council from the 1st week of January, 2023 which continued for two weeks and the same resulted in dismissal of the said M.A. No. 220 of 2019. It is next submitted that the petitioner has very good grounds to agitate in M.A. No. 220 of 2019 and unless M.A. No. 220 of 2019 is restored to its original file, the petitioner will be highly prejudiced. Hence, it is submitted that the M.A. No. 220 of 2019 be restored to its original file. Considering the aforesaid submission of the learned counsel for the petitioner, M.A. No. 220 of 2019 is restored to its original file to the stage at which, it was before its dismissal.
