SANJAN AAWASTHI INDU Versus RAKESH KANWAR AND ANOTHER CMP-29263 of 2025 in COPC - 318 of 2025 30.12.2025 Present: Mr. Rajesh Kumar, Advocate, for the applicant/ petitioner. Mr. Anup Rattan, Advocate General with Mr. Rajan Kahol, Additional Advocate General, Mr. Ravi Chauhan & Mr. Anish Banshtu, Deputy Advocates General, for the non-applicants/respondents. Learned counsel for the petitioner, after having perused instructions dated 27.12.2025, issued under the signatures of Director of School Education, Himachal Pradesh, placed on record by the learned Additional Advocate General, though fairly states that services of the petitioner have been regularized w.e.f 28.05.2019 (from the date other contractual employees were regularized) at the present place of posting in the pay band of Rs.10,300-34,800/- plus Grade Pay Rs.4200/-, but there is no mention with regard to consequential beneiits. Having carefully perused office order dated 26.12.2025, passed by Director of School Education, Himachal Pradesh, Shimla, this Court finds that services of the petitioner have been regularized w.e.f 28.05.2019 (from the date other contractual employees were regularized) at the present place of posting in the pay band of Rs.10,300-34,800/- plus Grade Pay Rs.4200/- along with other allowances admissible from time to time subject to final outcome of LPA. Since it is quite apparent from the mandate contained in the judgment, alleged to have been violated, that all consequential benefits have been ordered to be paid, learned Additional Advocate General fairly states that consequential benefits, if not already released, shall be released expeditiously. In view of the above, nothing remains to be adjudicated in the instant proceedings and accordingly, the same are closed. However, respondents are directed to ensure that consequential benefits in terms of mandate contained in the judgment, alleged to have been violated, are released expeditiously, preferably within four months from today.
