Counsel for the Respondent/complainant 1.PUBLIC PROSECUTOR The Court made the following ORDER: This Criminal Petition, under Sections 480 and 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023, has been filed by the petitioner/A1, seeking regular bail, in Crime No.522 of 2024 of Tirupati East:Police Station, Tirupatj district. 2. Originally, a case has been registered against the petitioner herein and others for the offences punishable under 2 sections 352, 353(1)(C) and 353(2) of the Bharatiya Nyaya sanhita, 2023. Later, during the COurSe Of investigation, the section of law was altered tO Sections 352, 353(1)(C), 353(2), 111(2)(b),196, 336(4), 356(2) read with 49 and 61(2) of the Bharatiya Nyaya Sanhita, 2023. 3. Case of the Prosecution, in brief, is that, the Petitioner herein is alleged to have created a video and posted in his X account (Twitter) @ Jagan Fantics on 02.10.2024, at about 18.36 hours, with the knowledge and intention tO defame Sri Pavan Kalyan and his spouses. 4. Heard. Perused the record. 5. Irrespective of the facts mentioned in the FIR, the petitioner herein was arrested on o8.ll.2024 and since then he is in judicial remand for a period of 60 days. Learned Assistant public prosecutor submitted that during the-course of investigation police have added section 111(2)(P) of the BNS and major portion of investigation has been completed. A perusal of the material on record, pr,'ma faC,'e, g-O:eS tO Show that the ingredients of section 111 (2)(b) Of the BNS would not attract against the petitioner herein, for the reason that no other charge To, Jr sheet has been filed against the petitioner herein before any competent 'courf within the preceding period of ten years| 6® ln view of the fact that the petitioner herein is languishing in jail since 08.ll.2024 and since major portion Of investigation is completed, this court is inclined to grant bail to the petitioner/Al on the following conditions. i) The petitioner/Al shall be released On bail on his executing a personal bond for Rs.10,000/- (Rupees Ten Thousand only) with two sureties of the like sum each to the satisfaction of the learned ll Additional Judicial Magistrate of First Class, Tirupathl'. ii) on release, the petitioner shall appear before the Station House Officer concerned, once in a week i.e., on every Saturday between 10.00 am and 01.00 pm, till filing of the charge sheet. 7.
