Neutral Citation No. - 2025:AHC:20911 Court No. - 68 Case :- CRIMINAL MISC. BAIL APPLICATION No. - 4181 of 2023 Applicant :- Ram Chandra Maurya @ Neta Opposite Party :- State of U.P. Counsel for Applicant :- Abhishek Singh,Shabana Nizam Counsel for Opposite Party :- G.A. Hon'ble Ashutosh Srivastava,J. Heard learned counsel for the applicant, Shri Arimardan Yadav, learned A.G.A. as well as learned counsel for applicant and perused the record. By means of this application, the accused-applicant, Ram Chandra Maurya @ Neta, who is said to be involved in Case Crime No. 306 of 2022, under Sections 401, 411, 413, 414, 419, 420, 272, 34 of I.P.C.,and Section 60 of Excise Act, Police Station- Gopiganj, District- Bhadohi, is seeking enlargement on bail. Learned counsel for accused-applicant argued that the accused- applicant is innocent; he has been falsely implicated in this very case crime number and is languishing in Jail since 23.10.2022; accused-applicant have criminal history of so many cases, which is clearly explained in para no. 3 of the supplementary affidavit and in some of them he is on bail; alleged recovery has been falsely implicated upon the applicant by the police; there is no likelihood of fleeing from course of justice or tampering with evidence in case of release on bail. Hence, bail has been prayed for. Learned A.G.A. has vehemently opposed the prayer for bail with this contention that a large number of criminal cases have been registered against the applicant under different sections and two motorcycles, one pistol and poisonous liquor have been recovered from the possession of applicant and co-accused, which shows his clear involvement in the alleged incident. It is harmful for the society to release on bail such type of notorious criminal, therefore his bail is liable to be rejected. Having heard learned counsel for both sides and gone through materials available on record, prima facie offences under aforesaid sections is made out and also keeping in view a large number of criminal history against the applicant, no fit ground for bail is made out. Accordingly, this Bail Application stands rejected. Order Date :- 27.1.2025 VS Digitally signed by :- VIBHA SINGH High Court of Judicature at Allahabad
