ORDER: This Writ Petition is filed under Article 226 of the Constitution of India seeking the following relief; to issue order or orders one in the nature of writ of Mandamus declaring the delay and inaction on the part of the respondents specifically respondent No. 2 on the application made by the petitioner for survey of his land even after issuing receipt No. 11/2024-25/8494 dated 14.11.2024 for the same as illegal, arbitrary and violative of principles of natural justice and contrary to Article 14 and 300(A) of Constitution of India and consequently direct the respondents specifically Respondent No. 2 to allot a surveyor to survey the lands of the petitioner pursuant to the application and it’s receipt dated 14.11.2024 ” The petitioner is the absolute owner of the land in Survey Nos.1825 and 1827 of an extent of 937.74 square meters of Gudur Mandal, Tirupati District, having acquired the same through a registered settlement deed vide Document No.2480/2023. While the matter being so, the petitioner has
2. approached the 2"^^ respondent requesting to appoint a surveyor to survey his land by duly paying the necessary fee as directed by the 2'^^ respondent and respondent also issued a receipt No.11/2024-25/8494, dated
14.11.2024. But, in spite of the same, as the respondent has not proceeded for conducting a survey in the petitioner’s land, the present writ petition is filed, respondent nd in turn the 2 nd The learned Standing Counsel representing the 2 furnished a copy of instructions of the Commissioner, Gudur Municipality dated 08.01.2025, wherein it is stated that after verifying the written
3. application and registered document vide No.2480/2023 submitted by the \
3 petitioner, it is noticed that the land in Sy.Nos.1825 and 1827 of an extent of 937.74 square meters in West Gudur, Tirupati District, has been inherited from the petitioner’s mother. But, however, after verification of the said survey numbers in the online Web land Adangal, it was found that the names of the petitioner and his inheritance are not matching and also not displayed. Hence, they issued a notice to the petitioner requesting to submit the details of the adjacent land holder, link documents and E.C. of the said property to conduct survey. It is further stated that Town Surveyor had already been appointed by their office.
Accordingly, the Town Surveyor, Gudur Municipality, also issued a notice on 19.11.2024, requesting the petitioner to submit the details of the adjacent land holders, link documents and E.C. of the said property so as to proceed further to conduct the survey. As the petitioner has failed to submit the said documents, they could not proceed further. 4. In view of the fact that the Town Surveyor has already been appointed in pursuance of the application submitted by the petitioner seeking survey and the Town Surveyor has also issued a notice on 19.11.2024 requesting the petitioner to submit the details of the adjacent land holders, link documents and E.C. of the said property, which are awaited for completing the process of survey. 5. This Court is of the opinion that the Writ Petition can be disposed of, with a liberty to the petitioner to submit the documents as requested by the Town Surveyor vide notice dated 19.11.2024 within a period of two (2) weeks from the date of receipt of a copy of the order and upon submission of such \ /
4 documents, the Town Surveyor shall complete the survey within a period of four (4) weeks thereafter. Accordingly, this writ petition is disposed of. No costs. Miscellaneous petitions pending, if any, in this Writ Petition shall stand
