THE HONOURABLE SRI JUSTICE K SREENIVASA REDDY QBIMINAL PETITION NO: 9636 of 2024_ ORDER: The CrimI'naI Petition, u/See.482 of the Bharatiya Nagarik Suraksha Sanhita, 2023, is filed on behalf of the petitioner/A2 to grant anticipatory bail in connection with Crime No.603/2024 of Ongole Taluk Police Station, Prakasam District. 2. A case has been registered against the petitioner and others for the offences punishable under Sections 120B, 405, 408 and 409 lPC. 3. This is a case of misappropriation of funds of the District Co- operative Marketing Society, Ongole that occurred prior to 15.ll.2023 at the District Co-operative Marketing Society Limited, Prakasam District, Ongole situated at South Byepass, opposite to sanghamitra Hospital, Ongole. A1, acting as non-official chairman, A2 being Superintendent and A3 being Accountant of the Society, conspired together to grab the sale proceeds and thereby misappropriated funds of the society to a tune of Rs.3,51,35,047.20 paise and withdrew the amount. 4. Heard. Perused the record. 5. Learned Assistant Public Prosecutor submits that the investigation is not completed and some more witnesses have to be examined. 6.

The petitI'Oner is a Government employee workI'ng aS an Assistant Regl'strar. ln connectI'On with the same, an enquiry under section 51 of the co-operative societies Act,1964 has been initiated. Thereafter, pending the enquiry, the case has been regl'stered against the petitioner and others on the allegation of misappropriatl-on. The accusation as against the petl'tI'Oner, as per the Fl'rst Information Report, is to the extent that he made signatures on' the cheques along with Al in the aforesaid transaction and the funds misappropriated have been transferred to A3. Irrespective of the accusation that has been made, this court is of the opI'niOn that since an amount of Rs.2,98,40,000/-has been repal-d to the co-operative society and the petitI'Oner being a Government employee, this court is inclined to consider the prayer of the petitioner/A2 for grant of anticipatory bail. 7. Accordingly, I'n the event of his arrest with regard to thl-s crl®me, Petitioner/A2 shall be released on bail on his executing a personal bond for a sum of Rs.25,000/- (Rupees twenty five thousand only), with two sureties each for the like sum to the satisfaction of the arresting police offl'cials and also on condition that the petitl-oner shall make himself c'_-+ I ._? _.-
available for investigation as and when required and that he shall not cause any threat, inducement or promI-Se tO the Prosecution Witnesses. The petitl|oner shall appear before the station ,House Offilcer concerned, once in a week i.e. on every sunday between 10.00' a.m. and 05.00 p.m., till filing of the charge-sheet. 8.
