No. 969 of 2025 ------ Chandra Kishor Paul @ Chandra Kishor Pal, aged about 35 years, son of Late Niranjan Paul, resident of Village –Basariya, P.O. –Khairachatar, P.S. –Kasmar, District –Bokaro, Jharkhand. .... .... …. Petitioner Versus The State of Jharkhand .... .... .... Opp. Party ------ CORAM: HON'BLE MR. JUSTICE ANIL KUMAR CHOUDHARY ------ For the Petitioner : Mr. Sachin Mahato, Advocate For the State : Mr. Subodh Kr. Dubey, Addl. P.P. ------ Order No.02 Dated- 02.05.2025 Heard the parties. This criminal miscellaneous petition has been filed at the instance of the petitioner for restoration of Cr.M.P. No. 1651 of 2024 to its original file. Learned counsel for the petitioner submits that Cr.M.P. No. 1651 of 2024 was dismissed for non-prosecution. It is next submitted that due to inadvertence, the cause list could not be properly marked by the learned counsel and therefore, he was unable to appear on behalf of the petitioner when the case was called out. It is next submitted that the petitioner has very good grounds to agitate in the said Cr.M.P. No. 1651 of 2024 and unless Cr.M.P. No. 1651 of 2024 is restored to its original file, the petitioner will be highly prejudiced. Hence, it is submitted that the Cr.M.P. No. 1651 of 2024 be restored to its original file. Considering the aforesaid submission of the learned counsel for the petitioner, Cr.M.P. No. 1651 of 2024 is restored to its original file to the stage at which, it was before its dismissal. List Cr.M.P. No. 1651 of 2024 under the appropriate heading after a week. (Anil Kumar Choudhary, J.) Sonu/Gunjan-
