1. Instant petition has been filed under Section 12 of the Contempt of Courts Act, 1971, (for short “1971 Act”) for proceeding against the respondents under the provisions of the 1971 Act on account of violation of an undertaking given by them in settlement/agreement dated 21.04.2023, Annexure P-6, arrived at before the Mediation and Conciliation Centre of this Court.
2. Heard counsel for the petitioner.
3. An agreement arrived at between the parties before the Mediation Centre cannot be termed as an agreement before a Court. When a party alleges that the terms have not been complied with, provisions of the 1971 Act would not be attracted.
4. Petition is not maintainable.
