2. The petitioner is apprehending his arrest in connection with Loyabad P.S. Case No. 05 of 2025, for the alleged offences registered under Sections 140, 142, 308(4), 127(4), 318(4), 61(2), 3(5) of the B.N.S., pending in the Court of learned J.M.F.C., Dhanbad.

Learned counsel appearing for the petitioner submits that the petitioner has been implicated in the FIR on the ground of suspicion and the informant has no concern with the person, namely, Tulsi Bhuiya who is shown as a victim. He also submits that the victim, namely, Tulsi Bhuiya has filed one informatory petition being Misc. Case no 57 of 2024, before the learned Executive

Magistrate, Dhanbad stating therein that the informant of the present case along with other co-accused person trying to grab the retiral benefit of the victim, namely, Tusli Bhuiyan. He further submits that when it has come into the knowledge of Tulsi Bhuiyan about the present case, Tulsi Bhuiyan has filed M.C.A. No. 1067 of 2025 before the learned J.M.F.C., Dhanbad stating therein that false F.I.R has been lodged against the petitioner by the informant and main culprit is the informant himself. He then submits that the petitioner has helped to protect Tulsi Bhuiyan with regard to any mischief made by the informant and in view of the above, the petitioner has been falsely implicated in the present case.

Learned counsel appearing for the State submits that the allegations are made against the petitioner of keeping in house the uncle of the informant.
5. In course of the argument, it has been pointed out that the uncle of the informant is very much present in the society. Even the person who is said to be the uncle of the informant is said to be a fake person. Tulsi Bhuiyan is the victim and he has filed the informatory petition before the learned Executive Magistrate and the another petition

before the learned Judicial Magistrate stating that the informant is the main accused. In the attending facts and circumstances, I am inclined to grant anticipatory bail to the petitioner.
6. Accordingly, the petitioner, above named, is hereby
directed to surrender before the learned Court within three weeks from today, and in the event of his surrender/arrest, the petitioners, above named, shall be released on bail, on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand), with two sureties of the like amount each, to the satisfaction of learned J.M.F.C., Dhanbad in connection with Loyabad P.S. Case No. 05 of 2025, subject to the conditions as laid down under Section 482(2) of Bharatiya Nagarik Suraksha Sanhita, 2023.
