This Contempt Case is filed for willful violation of the orders passed by this Court in I.A.No.2 of 2020 in W.P.No.18347 of 2018 on 06.09.2022, wherein this Court passed the following order:
“Heard learned counsel for the petitioner and learned Standing Counsel for the A.P.S.R.T.C.
Having regard to the facts and circumstances of the case and considering the
submissions of both the counsel, there shall be an interim direction directing the petitioner to make a fresh representation to the respondents requesting to provide alternative job as a Female Nurse in any of the dispensaries of the A.P.S.R.T.C. within a week and on receiving the said representation, the respondents shall consider the same and pass appropriate orders taking into consideration the certificate issued by the Andhra Pradesh Nurses, Midwives, Auxiliary Nurse- Midwives and Health Visitors Council, Hyderabad, within a period of three (03) weeks”.
2. Today, when the matter came up for hearing, Mr.M.Solomon Raju,
learned counsel for the respondents has furnished the proceedings of APSRTC Medical Board that met on 13.06.2023. As per which, after thorough examination of the petitioner’s medical reports and specialist opinion, the Medical Board has found that the petitioner is fit for holding A2 category post in APSRTC. As such, requested to close the contempt.
3. The said submission has been seriously opposed by learned counsel for the petitioner stating that initially, the petitioner’s case was rejected for appointment to the post under A2 category in APSRTC. As such, the petitioner was constrained to file I.A.No.2 of 2020 in W.P.No.18347 of 2018 with a request to direct the respondents to provide an alternative job as a
4
female nurse in any of the dispensaries of APSRTC and in pursuance of the directions issued by this Court on 06.09.2022, the respondents have come up with a stand that the petitioner is fit for holding A2 category post in APSRTC.
4. Duly considering the contentions made by learned counsel for the petitioner and as well as the learned counsel for the respondents and in view of the fact that the respondents have considered the representation made by the petitioner and thereafter, sent the petitioner for medical board and after thorough examination of the petitioner’s medical report and specialist opinion, the medical board has found that the petitioner is fit for A2 category post in APSRTC, this Court is of the opinion that the orders passed by this Court in I.A.No.2 of 2020 in W.P.No.18347 of 2018 on 06.09.2022, have been complied with. However, if at all the petitioner has any further grievance, he/she is at liberty to assail the same in the main writ petition.
5. Accordingly, the Contempt Case is closed. There shall be no order as to costs.
As a sequel, miscellaneous applications, pending, if any, shall also stand closed. __________________ JUSTICE V.SUJATHA Date: 13.08.2025 JLV
