SAILESH REDDY, Advocate for the Petitioner and of public Prosecutor for Respondent No.1, the Court made the following. ORDER THE HON'BLE SRI JUSTICE K. SREENIVASA REDDY CRIMINAL PETITION NO.9556 OF 2024 ORDER : The Criminal Petition, under Section 482 of the BNSS, is filed on behalf of the petitioners herein/A3 and A5 to grant anticipatory bail in connection with Crime No.127 of 2024 of Pullala Cheruvu Police Station, Prakasam District, registered for the offences punishable under Sections 447, 427, 467, 471, 472, 420 and 506 read with 120B IPC. 2. Case of the prosecution is that the accused forged and fabricated documents including the counterfeit seal of Naga Mohana Kiran Agro Farm. By using these forged documents, they executed sale deeds in favor of A3, A5 and other accused. The registration of the land admeasuring to an extent of 89.59 acres in Survey No.24 located in the Manepalli Village revenue area of Pullacheruvu Mandal was fraudulently completed`at the Sub Registrar Office in Rajanagaram. 3. Heard. Perused the record. 4. A perusal of the material on record goes to show that the main accusation as against the petitioners is that they alienated the property belonging to the firm. The petitioners retired from the partnership firm but the said retirement of the petitioners herein has not been registered and the same has not been disclosed by the Register of Companies. In view of the saI'd reason, aS On today, when the property has been alienated in favor of the defacto -E- complainant, they are partners in the said firm and the same Its legal in the eye of law. 5. A plain readl'ng of the paragraph No.6 of the partnership deed also dl'scloses that the partnership is free to honor the leasehold agreements, sale deeds of immovable property executed prior to or after the date of the partnership by any partner or a" the partners. In vI'eW Of the aforesal'd condition, the petl'tioners herein alienated the property l'n favour of the defacto complaI'nant by virtue of the same and there is no illegality committed by the petitioners herein. 6. ln view of above facts and circumstances of the case, this court I-s inclined to consider request of petitI-OnerS for grant of anticI'PatOry bail. 7. Accordingly, I'n the event of their arrest, petI'tiOnerS herein/A3 and A5 sha" be released on bail on each of them executing a personal bond for a sum of Rs.10,000/-(Rupees ten thousand only), wI-th two Suretl'es each for the like sum each to the satisfaction of the arresting police officials, and also on condition that the petI'tl'OnerS shall make themselves available for I-nVeStjgation as and when required and that they shall not cause any threat, inducement or promise to the prosecution witnesses. The petitioners sha" appear before the station House Officer concerned once jn a week l'.e., on every saturday between 10.00 a.m. and o1.00 p.m., tl'Il filing of the charge sheet. 9.
