1. Mr. Jain, learned counsel for the respondent – State submitted that the petitioners were working through a placement agency – respondent No.4, and their contract have been determined by the respondent - State vide order dated 09.07.2020 on account of unsatisfactory work performance.
2. He argued that since the contract awarded to respondent No.4 had been terminated, the petitioners cannot claim any right
[2025:RJ-JD:2032] (2 of 2) [CW-6802/2020] to continue with the respondent – State. It is also argued that the petitioners were engaged as Auxiliary Nurse and Midwife (ANM) since 2020, and two regular recruitments on the post of ANM had taken place and, therefore, the contention of the petitioners to continue their contractual engagement, is not in accordance with law.
3. In view of the aforesaid, the present writ petition is disposed of while directing the respondents to engage the petitioners in case any vacancy on the post of ANM is available and respondent - State is proposing to engage ANM on contractual basis.
4. Stay application also stands disposed of accordingly.
