PUBLIC PROSECUTOR The Court made the following ORDER: This Criminal Petition, under Section 482 of Bharatiya Nagarik Suraksha Sanhita, 2023, has been filed by the petitioner/A2, seeking anticipatory bail, in connection With Crime No.269 of 2024 of Kadiam Police Station, East Godavari district, registered for the offence punishable under section 7-B read with 8(B) of the^A.P. Prohib'ltion (Amendment) Act, 2020. .,. ` 2 /J 2. Case of the prosecution, in brief, l's that, on o6.09.2024, on credible information, the Sub-Inspector of police, Kadiyam Police Station, along with his staff and mediators, proceeded to near Lutheran Church, Kadiyam village and found Al in possession Of 15 litres of lD arrack. Al confessed that A2 gave him the said arrack for the purpose of sale. police seized the lD liquor under cover of a mediators report and a case has been registered against the accused. 3. Heard. Perused the record. 4. A perusal of the material on record goes to show that basing on the confessional statement of co-accused, the name of the petitioner herein was shown as accused in the present crl'me. Except the confessional statement of co-accused, there is no other material to connect the accused to the alleged crime and pursuant to the said confession no incriminating material has been seized from the possession of the petitioner herein/A2. 5. ln view of the aforesaid facts and circumstances of the case, this Court is inclined to grant anticipatory bail to the Petitioner herein/A2 on the following conditions, i) In the event of arrest of the petitioner herein/A2 in the aforesaid crime, he shall be enlarged on bail on his executing a y('c,\-i= iB!ir _- a i<\ \!\l \' d` 3. personal bond for a sum of Rs.10,000/-(Rupees Ten Thousand /? only) with tvio' sureties Of the like Sum each tO the Satisfaction Of the concerned Arresting Officer. ii) petitioner shall make himself available for interrogation by a police officer as and when required, and he shall not, directly or indirectly, make any inducement, threat Or Promise tO any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the Court or to any police officer. iii) petitioner shall appear before the Station House Officer concerned once 'ln a week i.e., on every Sunday between 10.00 AM and 01.00 PM till filing of charge sheet. 6. Accordingly, the Criminal Petition is allowed.
