PUBLIC PROSECUTOR The Court made the following ORDER: This Criminal Petition, under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023, has been filed by the petitioner/A-3, seeking anticipatory bail, in connection with Crime No.53 of 2024 of Special Enforcement Bureau Station, Paderu, Alluri Sitharama Raju district. 2 2. A case has been registered against the petitioner herein and others for the offence punishable under Section 8(c) read with 20(b)(ii)(C) of the Narcotic Drugs and Psychotropic Substances Act, 1985 (for short ‘the NDPS Act’). 3. Case of the prosecution, in brief, is that, on 13.02.2024, on credible information, the Enforcement Sub-Inspector of Police, DTF SEB, Paderu, along with his staff and mediators, while conducting vehicle checking near Chinthalaveedi village junction, found A4 and A5 in possession and illegal transportation of 738 Kgs of Ganja in a Bolero Pickup Van bearing registration No.AP 31 TA 8109. On seeing the police party, A5 escaped from the spot. A4 confessed about the involvement of A1 to A3 also in this crime. The contraband along with vehicle and other material was seized under cover of a mediators report and a case has been registered against the accused. 4. Heard. Perused the record. 5. A perusal of the material on record goes to show that 738 Kgs of ganja was seized from the possession of the accused, which is a huge commercial quantity. It is submitted by the learned Assistant Public Prosecutor that investigation is not yet completed. 3 6. In view of the aforesaid facts and circumstances of the case, this Court is not inclined to grant bail to the petitioner/A3. 7.
