I N THE HIGH COURT OF JUDICATURE FOR RAJASTHAN AT JODHPUR D.B. Habeas Corpus Petition No.13/2016 Pradeep Bishnoi vs State of Rajasthan & Ors. .Date of Order : : 22.01.2016 HON'BLE MR. JUSTICE GOPAL KRISHAN VYAS HON'BLE MR. JUSTICE P.K.LOHRA Mr.Vinod Sharma for the petitioner. Mr. S.K. Vyas, AAG-cum-Govt. Advocate. I n pursuance of order dated 21.01.2016, the learned Addl. Advocate General-cum-Govt. Advocate produced before us the details of the cases registered in the Police Station Chopasani Housing Board, Jodhpur while exercising the powers under Section 151 Cr.P.C. & 107 Cr.P.C. As per the details, in last week, three cases were registered under Section 151 Cr.P.C. The first case was registered on 16.01.2016 against one Kishan S/o Shri Bhoja Ram. Second case was registered on 18.01.2016 against Sharwan S/o Shri Amara Ram and the third case was registered against the petitioner under Section 151 Cr.P.C. After perusing the information furnished by the learned Addl. Advocate General, we are satisfied that three cases were registered in the last week of January, 2016 at Police Station Chopasani Housing Board. It is also obvious from the facts that the petitioner was arrested under Section 151 Cr.P.C, and he was released by the Court. The petitioner was again arrested in connection with FIR No. 19 dated 18.01.2016 registered against
him for the offences under Sections 420, 406 and 448 IPC and was produced before the concerned Magistrate today and a prayer has been made for granting remand for the investigation. I n view of the aforesaid facts, it is obvious that the petitioner was not in illegal detention but the learned counsel for the petitioner is disputing the fact and submits that the petitioner was illegally retained in the Police Station and thereafter arrested under Section 151 Cr.P.C. without any reason. I n view of above facts, the instant habeas corpus petition is hereby dismissed because as per details submitted before us, the petitioner is not in illegal detention. However, if any grievance remained with the petitioner that he was arrested illegally then he will be at liberty to take action in accordance with law.
