The Court made the following Order:
The present writ petition is filed seeking the following relief:
“……….to issue a writ, order or direction especially in the nature of Writ of Mandamus or any other appropriate writ declaring the action of the respondent Nos.2 and 3 in issuing section 6 notification under Land Acquisition Act vide proceedings Ref.B1/77/2012 dated 02.07.2013, showing the 5th respondent as owner of the lands to an extent of Ac.2.47 cents in S.No.216/1A, 216/3A and 217/1 of Dandangi Village, Devipatnam Mandal, East Godavari District, without considering the claim of the petitioners is illegal, arbitrary and violative of principles of natural justice, contrary to the Land Acquisition Act, 1894 and Rules made there under and consequentially direct the respondent Nos.2 and 3 to refer the dispute to the competent civil court…….”
At the time of considering the matter, the learned Assistant Government Pleader for Land Acquisition placed a copy of the latest instructions dated 23.10.2024 received from the 3rd respondent, wherein it is inter alia stated as follows:
“An Award bearing No.03/2015 dated 05.05.2015 was passed by the L.A.O & Special Deputy Collector (LA), Indira Sagar Project, LMC-I, Rajahmundry. An Amount of Rs.53,56,880/- was awarded in favour of Sri Paka Atchutaramayya, S/o.Salmun O.S.No.24/2011 in the court of Agent to Government & Collector, Kakinada for this extent of land is pending.
Hence the compensation due to the above land is ordered to be deposited in the Authority U/s.77(2) of LA R&R Act 30 of 2013 and the same was deposited to LA, R&R Authority, Visakhapatnam through Challan No.61293145932022, dt.24.11.2022.”
In view of the same, the writ petition is dismissed. However, the petitioners are at liberty to agitate their claims before the competent authority. No order as to costs.
