No. 8405 of 2025:- This interlocutory application has been filed on behalf of the petitioner for removing/ignoring the defect No.247(b). 2. Learned counsel for the petitioner submits that the petitioner is bed ridden since 2019 and a power of attorney has been executed by the petitioner/mother of the pairvikar of this C.M.P. for adjudicating this case in the court of law. 3. In view of the aforesaid facts I.A. No. 8405 of 2025 is disposed of. I.A. No. 5360 of 2025:- 4. This application has been preferred by the petitioner for condoning the delay of 508 days in filing the C.M.P., the details of which has been mentioned in paragraph Nos. 3 to 7. 5. Having been satisfied with the reasons assigned in the instant application, the same is allowed and the delay of 508 days in filing the 2025:JHHC:33108 2 C.M.P. is hereby condoned. 6. Accordingly, I.A. No. 5360 of 2025 is allowed. C.M.P. No.648 of 2025:- 7. This application has been preferred for restoration of F.A No. 02 of 2022 which was dismissed for default on 01.11.2023 for non-compliance of the order dated 20.09.2023. 8. On consideration of the reasons assigned in the instant application, the same is allowed and F.A No. 02 of 2022 is restored to its original file. (Pradeep Kumar Srivastava, J.) 06.11.2025 Arpit
