Order 07/01/2025
1. Heard learned counsel for the parties.
2.
Learned counsel for the petitioners submits that a detailed
order in CWP No.12695/2024 was passed by a Coordinate Bench of this Court on 31.07.2024, which reads as under :-
[2025:RJ-JD:794] (3 of 4) [CW-14368/2024]
“1. Mr. Akhilesh Rajpurohit, learned counsel for the petitioner submits that some persons have blocked all the gates of the petitioner’s mines/plant at Zawar, District Salumber and Udaipur and they are neither permitting the staff present outside the mines gate to enter the mines nor are they permitting the workers working in the mines to come out.
2. Learned counsel submits that these people in the name of Dharna are exhibiting complete hooliganism. He added that their demand seeking employment is absolutely unjustified. While informing that hundreds of workmen are working in the mines and offices and most of them are local people.
3. Learned counsel submits that the company has provided employment/opportunities in the State of Rajasthan and is striving hard to generate more employment, but the same cannot be done overnight and Dharnas and stopping the mining activities and other illegal means work against its endeavours.
4. Learned counsel submits that in spite of the fact that a representation was made before the concerned Superintendent of Police (District Salumber and Udaipur) on 29.07.2024, no heed has been paid.
5. Learned counsel submits that on account of the act of the miscreants, who have literally stopped the mining operations of petitioner’s mines at Zawar, it has become impossible for the petitioner’s company to operate its unit on the one hand and on the other hand, the non- functioning of the mining unit of the petitioner would cause loss not only to the petitioner, but also to the State exchequer.
6. Learned counsel submits that earlier also such attempts were made in petitioner’s Sindesar Khurd Mines, Rajsamand and another unit of Birla Cement Works, Chitttorgarh and the Court has issued an appropriate direction to the administration.
7. In the opinion of this Court, such activities cannot be tolerated and the State Administration cannot turn a blind eye towards such activities.
