Charge sheet is filed against the petitioner for offences punishable under Section 363, 376 of IPC and - 3 - NC: 2025:KHC:5068 CRL.P No. 13344 of 2024 Section 6 of Protection of Children from Sexual Offences Act, 2012. 3. It is alleged that on 21.03.2024 at about 10.00 a.m., petitioner kidnapped the minor victim aged about 16 years and took her to the room of CW.2 and committed penetrative sexual assault on her against her wish and repeated the said act till 19.05.2024. 4. Learned counsel for petitioner has sought permission of the Court to withdraw the petition with liberty to the petitioner to file a bail petition before the Sessions Court after the examination of the victim. 5. In the light of the above submission, petition is dismissed as withdrawn, reserving liberty to the petitioner to file a fresh bail petition before the Sessions Court after the examination of the victim girl. 6. Considering that the petitioner is in judicial custody since 20.05.2024 and having regard to the fact that the charge sheet is already filed, learned Sessions - 4 - NC: 2025:KHC:5068 CRL.P No. 13344 of 2024 Judge shall make every endeavour to record victim’s evidence as expeditiously as possible, keeping in view the relevant provisions of the POCSO Act, 2012.
