D PURNACHANDRA REDDY couNSEL FOR THE RESPONDENT : PuBLIC PROSECUTOR THE COURT MADE THE FOLLOWING ORDER . .I THE HONOURABLE SRI JUSTICE K SREENIVASA REDDY CRIMINAL PETITION NO: 387 OF 2025 ORDER: This Criminal Petition, under Sections 480 and 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023, has been filed by the petitioner/A1, seeking regular bail in Crime No.97/2024 of RSASTF PolI'Ce Station, Tirupathj. 2. A case has been registered against the petitioner and others for the offences punishable under Sections 303(2) r/w 3(5), 49 and 61 (2) of the B.N.S. and Sec.20(1)(d)(i)(a) r/w 20(1)(c)ii, iii, iv, x, 36(a) r/w 32A, 29(4)(a)(i) of the A.P. Forest (Amendment) Act, 2016. 3. Case of the prosecution is that: On 12.12.2024 at 6.00 am, the S.I. of RSASTF, Tirupati, on receipt of credible information about illegal possession and transportation of red sanders, rushed to Sundupalli-Sanipaya Road, Sanipaya forest beat section and conducted vehicle checking. They found one vehicle i.e. lnnova car bearing registration no.AP 39 NS 9567 coming from Sanipal side in a high speed and stopped at some distance, and on seeing the policel the inmates in the vehicle tried to escape. Then police apprehended them and on enquiry they disclosed their identity particulars. Police found 10 red sander logs, arrested the said persons and seized the red sander logs. 4. Heard. Learned Assistant p.p. submits that major part of the investigation is completed and charge sheet could not be filed as co-accused in the aforesaid crime were absconding. He further subml'ts that the petitioner was taken into police custody during the remand perI-Od. 6. On a perusal of the material available on the record goes to show that the petitioner and another were found carrying about 10 red sander logs in a car,, then police arrested them on the same day and seized the red sander logs on 12.12.2024. Since then the petl-tioner/Al is in judicial remand. As the major portion of investigation is completed, any continued detention of the petl'tl-oner does not seem necessary. 7. ln view of the aforesaI-d facts and Circumstances Of the Case, this Court is inclined to grant bail to the petitioner herein, on the following conditions. (i) The petitioner/Al herein shall be released on his executing a Personal bond for Rs.10,000/- (Rupees ten thousand only) with two sureties for a like sum each to the satisfaction of the Judicial Magistrate of First Class for trial of cases relating to Red Sanders Smuggling, Tirupathi; (ii) On release, the petitioner shall appear before the station House Officer concerned once in a week i.e. on every sunday between 10.00 a.m. and 05.00 p.m., till filI'ng Of Charge Sheet. 8.
