ORAL JUDGMENT (PER: HON'BLE THE CHIEF JUSTICE MR. JUSTICE N. V. ANJARIA)
While not entertaining the prayer for review of the order passed in Writ Petition No.291 of 2023, learned Single Judge in his
order dated 13.06.2023 disposing the review petition, clarified that the respondent-Corporation shall consider the case of the petitioners in light of two existing Gradation lists dated 15.10.2022 and 19.10.2022, in considering the case of the petitioners for the purpose of promotion.
2. The above observations and directions are brought under the contempt jurisdiction of this Court by filing this petition.
3. On the bare reading of the aforesaid observations and directions, it could be seen that for the purpose of compliance, learned Single Judge has not prescribed any time limit.

4. In the circumstances, it is not possible to conclude at this stage that any of the respondents have committed contempt of the Court, much less a willful contempt.
5. The contempt petition as presently filed is not entertainable.
6. At the same time, the directions of the Court should not go uncomplied with. Therefore, it is provided that the observations and directions of learned Single Judge shall be complied with by the competent authority within a period of twelve weeks failing which, the authority shall be exposed to the contempt.
7. The petition is disposed of accordingly.
