The applicant has preferred the first anticipatory bail application under Section 482 of the Bhartiya Nagarik Suraksha Sanhita, 2023 for grant of Anticipatory Bail, apprehending his arrest in connection with Crime No.157/2025, registered at Police Station –Lailunga District – Raigarh(C.G.) for the alleged commission of offence punishable under Sections 331(2), 296, 351(2) & 3(5) of BNS 2023. As per prosecution story in brief is that That a complaint was made by one Jyoti sidar on 07.06.2025 the present applicant who is the Ex- Chief of the Chhattisgarh Prantiya Arya Pratinidhi Sabha entered the school which is managed by the Arya Samaj along with the other co- accused and stared abusing the office bearers of school and threatened them. That on the basis of aforesaid complaint offences under section 331(2), 296, 351(2), 3(5) Bhartiya Nyay Sanhita, 2023 were registered against the present applicant along with other co- accused. 3. The applicant respectfully submit that he is innocent and has been falsely implicated in the alleged offences without any direct involvement or incriminating evidence against them. He is permanent residents of their respective addresses, have no criminal antecedents, and there is no likelihood of their absconding or tampering with evidence. The alleged offences are based solely on the memorandum statements of co-accused, and no recovery or seizure has been made from the applicants. In some cases, the applicants were not holding charge at the relevant time, and in others, they were implicated due to previous enmity or institutional rivalry. Co-accused in related matters have already been granted bail by this Hon’ble Court in MCRCA No. 937 of 2025 & MCRCA No. 992 of 2025. The applicant is willing to fully cooperate with the investigation, furnish adequate surety, and abide by any conditions imposed by this Hon’ble Court.
Hence, he pray for the grant of anticipatory bail in the interest of justice. 4. On the other hand, learned State Counsel as well as learned Counsel for the objector have opposed the prayer for anticipatory bail and
3 submitted that the applicant has four criminal antecedents, and recently, another case has also been registered against him in Crime No. 150 of 2025 under Sections 296, 351(2), 115(2), 190, 191(2), 192, 333, and 117(2) of the Bhartiya Nyaya Sanhita, 2023. Therefore, he is not entitled to the grant of anticipatory bail. 5. I have heard learned counsel for the parties and perused the case diary. 6. Considering the nature and gravity of the offence, and also taking into account the fact that the applicant is accused of having unlawfully entered the office of the Principal of Tularam Arya Kanya Sanskrit Aawasiya Vidyalaya, Gohridipa, Rajpur, where he committed marpeet with the Principal, Ms. Jyoti Satpathy, along with other staff members, and issued threats, and further, that he is alleged to have taken away the 'Dakhil-Karij' register from the school, and since the applicant appears to be the main accused in the present case, I am not inclined to grant anticipatory bail to the applicant,

Accordingly, the anticipatory bail application of the applicant – Acharya Anshudev Arya, involved in Crime No.157/2025, registered at Police Station – Lailunga District – Raigarh(C.G.) for the alleged commission of offence punishable under Sections 331(2), 296, 351(2) & 3(5) of BNS 2023, is rejected.
