IMPUGNED ORDER DATED 29.06.2024 PASSED IN REVISION PETITION NO.14/2024 ON THE FILE OF THE DEPUTY COMMISSIONER, BENGALURU (RESPONDENT NO.1) VIDE ANNEXURE-A.
THIS PETITION, COMING ON FOR PRELIMINARY HEARING, THIS DAY, ORDER WAS MADE THEREIN AS UNDER:
CORAM: HON'BLE MR JUSTICE N S SANJAY GOWDA
ORAL ORDER
1. This writ petition is filed challenging the vacation of an interim order by the Deputy Commissioner.
2. The Deputy Commissioner has passed the impugned
order dated 29.06.2024 by which he has vacated the interim order that he had granted on 06.01.2024 without assigning any reasons at all.
3. In my view, when the revision was pending, there was absolutely no justification for vacating the interim order and that too, without providing any reasons or justification for the vacation of the interim
order. Consequently, the impugned order is set aside.

4. The interim order, which was prevalent prior to the impugned order, shall continue till the disposal of the revision.
5. The learned counsel for respondent No.4 submits that there have been some subsequent developments under which further instruments have come into existence creating rights in favor of 4th respondent's children and it is also contended that the petitioners have also sold the lands and therefore, it would be appropriate to direct the purchasers as well as the subsequent successors in title to be impeded.
6. In light of the said submission, the Deputy Commissioner is directed to implead the purchasers, if any, from the petitioners and also the persons who are claiming right, title or interest from 4th respondent on the basis of the registered instruments executed during the pendency of the revision.
